La conférence nationale 2021 de l’EMN Luxembourg a porté sur la détection et la protection des migrants vulnérables dans la procédure de protection internationale.
La conférence a été introduite par la Prof. Dr Birte Nienaber, coordinatrice de l’EMN Luxembourg, Jean Asselborn, ministre luxembourgeois des Affaires étrangères et européennes, et ministre de l’Immigration et de l’Asile, et la Prof. Dr Catherine Léglu, vice-rectrice aux affaires académiques à l’Université du Luxembourg.
Après les mots de bienvenue, la conférence était organisée en deux sessions, l’une sur le niveau européen, l’autre sur le contexte luxembourgeois :
- La première session a présenté l’histoire du concept de la « vulnérabilité » d’un point de vue scientifique et a souligné les ambiguïtés conceptuelles qui surgissent lorsque la « vulnérabilité » est utilisée comme un outil pour mettre en œuvre des politiques de migration (Luc Leboeuf, projet H2020 VULNER). Ensuite, Nicolas Van Puymbroeck (l’Agence fédérale pour l’accueil des demandeurs d’asile – Fedasil, Belgique) a expliqué comment la détection des demandeurs de protection internationale vulnérables est organisée en Belgique, quelles difficultés se présentent, et quelles nouvelles idées liées au concept de « bien-être » ont émergé d’une recherche récente menée par Fedasil en Belgique. De plus, Ralph Petry de l’EMN Luxembourg a présenté les résultats de la note de synthèse de l’EMN Luxembourg intitulée « Vulnérabilités dans la procédure de protection internationale », donnant un aperçu des groupes vulnérables les plus courants, des cadres juridiques et procéduraux, ainsi que des garanties procédurales les États membres de l’UE appliquent aux migrants vulnérables lors de la procédure de protection internationale. Enfin, Anne Kayser du Conseil de l’Europe a conclu la première session en présentant le Plan d’action du Conseil de l’Europe sur la protection des personnes vulnérables dans le contexte des migrations et de l’asile en Europe (2021-2025) (vous trouverez le PDF ci-dessous).
- La deuxième session a pris la forme d’une table ronde portant spécifiquement sur la détection et protection des migrants vulnérables dans la procédure de protection internationale au Luxembourg. Des représentants de l’Office National de l’Accueil, de la Direction de l’Immigration, de Caritas Luxembourg, ainsi qu’un avocat spécialisé en matière de la migration et de l’asile au Luxembourg se sont échangé sur les acquis et les défis du système luxembourgeois. La table ronde a abordé les thèmes comme le cadre juridique et procédural au Luxembourg, la transmission d’informations entre les acteurs impliqués, ou encore les garanties procédurales applicables aux demandeurs de protection internationale vulnérables.

The EMN Luxembourg National Conference 2021 focused on the detection and protection of vulnerable migrants in the international protection procedure.
The conference was introduced by Prof. Dr. Birte Nienaber, coordinator of the EMN Luxembourg, Jean Asselborn, Luxembourgish Minister of Foreign and European Affairs, and Minister of Immigration and Asylum, and Prof. Dr. Catherine Léglu, Vice-Rector for academic affairs at the University of Luxembourg.
Following the welcoming speeches, the conference hosted two panels, one on the European level, and one on the Luxembourgish context:
- The first panel presented the history of the concept of “vulnerability” from a scientific perspective and highlighted the conceptual ambiguities that arise when “vulnerability” is used as a tool to implement migration policies (Luc Leboeuf, H2020 project VULNER). Furthermore, Nicolas Van Puymbroeck (Federal agency for the reception of asylum seekers – Fedasil, Belgium) explained how the detection of vulnerable applicants for international protection is organised in Belgium, what difficulties arise, and what new ideas related to the concept of “well-being” have emerged from a recent research conducted by Fedasil in Belgium. Additionally, Ralph Petry from the EMN Luxembourg presented the results of the EMN Luxembourg Inform entitled “Vulnerabilities in the international protection procedure”, giving an overview of the most common vulnerable groups, legal and procedural frameworks, as well as procedural safeguards EU Member States apply to vulnerable migrants in the international protection procedure. Anne Kayser from the Council of Europe concluded the first panel by presenting the “Council of Europe Action Plan on Protecting Vulnerable Persons in the Context of Migration and Asylum in Europe (2021-2025)” (find attached below).
- The second panel took the shape of an expert discussion focusing specifically on the detection and protection of vulnerable migrants in the international protection procedure in Luxembourg. Representatives from the National Reception Office (Office National de l’Accueil – ONA), the Directorate of Immigration (Direction de l’Immigration), Caritas Luxembourg, as well as a lawyer specialised in migration and asylum in Luxembourg discussed the achievements and challenges of the Luxembourgish system. The discussion addressed issues such as the legal and procedural framework in Luxembourg, the transmission of information between the actors involved, or the procedural guarantees applicable to vulnerable applicants for international protection.
